Agreement Overview This agreement contains the entire understanding between Freebird Photography and the Client. It supersedes all prior agreements. Changes must be made in writing and signed by all parties. A waiver of one provision does not waive any other provision.

Booking 50% of the session fee is due at the time of booking. This is a non-refundable retainer. If a session is cancelled due to unavoidable circumstances, the amount paid will be transferred as a credit toward a future session.

Photo Cooperation Parties agree to cooperate for the best possible result. Freebird Photography is not responsible for key individuals failing to appear or cooperate, or for missed images due to undisclosed details.

Limit of Liability If the photographer cannot perform due to illness or emergency, Freebird Photography will attempt to reschedule or provide a full refund. Liability for lost, stolen, or damaged materials (including equipment malfunction or mail loss) is limited to the return of all payments received.

Physical Liability Clients are responsible for their conduct. Any damage to studio equipment or contents is the financial responsibility of the Client. Clients hold Freebird Photography harmless for injuries sustained during or around the session. Abusive behavior will result in immediate cancellation and forfeiture of payment.

Model Release The Client grants Freebird Photography the irrevocable right to use and publish photographs of the Client for editorial, trade, advertising, or other purposes in any medium.

Appearance The photographer is not liable for reshoots or refunds regarding appearance factors outside of their control (e.g., hair, makeup, or clothing).

Images & Copyright All images are protected by Federal Copyright Law. Reproduction without written permission is prohibited. Commercial use, contest entry, or removing watermarks is strictly prohibited. Screen-grabbing or scanning images is illegal.

Payment Payment may be made via cash, check, or credit card.

Penalty Fees & Charges There is a $50 charge for returned checks. Freebird Photography is not responsible for items lost by postal services or due to invalid addresses provided by the Client.

Proofing & Ordering Editing typically takes 1 week (aiming for 1–3 days). Proofing occurs via in person but sometimes online galleries are allowed. No products are delivered until full payment is received. Digital products are delivered within a week of ordering; prints take 1–6 weeks. Once digital files are delivered, no refunds are available. This session includes digital files; upgrades are optional.
